Purpose and acceptance
These Terms govern the use of backupmeinstitute.com and of the Talk to Yourself, Marketplace and Echo-Vault products. By using the site or any of the products, you accept these Terms; if you do not accept them, please do not use the service.
Nature of the service
BackupME Institute provides language-modelling tools based on materials provided by the user or by whoever has the right to provide them. The service does not constitute medical, psychological or psychotherapeutic advice, and does not replace grief processing with a qualified professional.
Intellectual property
The site's code, design and text remain the property of BackupME Institute. Materials you provide (texts, recordings, photographs) remain your property or that of whoever legitimately provided them; you grant us only the licence necessary to build and run the requested profile.
Permitted and prohibited use
It is prohibited to use the products to impersonate third parties without their consent, to upload unlawful or defamatory content or content that infringes others' rights, or to attempt to circumvent the consent rules described for Echo-Vault.
Nature of the system and non-reality of characters
All BackupME Institute products are generative AI systems: no interaction takes place with the real person, living or deceased. For Marketplace and Echo-Vault, this is stated explicitly before every conversation, in accordance with Article 50 of the EU AI Act.
Limitation of liability
To the extent permitted by law, BackupME Institute is not liable for content generated by the system that turns out to be inaccurate, incomplete, or not matching what the real person would have said. The service is provided "as is", without guarantees of absolute continuity or accuracy.
Family consent for Echo-Vault
Activation of Echo-Vault requires the consent of whoever has the right to decide, under the rules described on the Products page and in the Privacy Policy. BackupME Institute reserves the right to suspend activation in case of disagreement among those with equal standing.
Changes to these terms
We may update these Terms over time; the version in force is always the one published on this page, with the date of the last update shown at the top.
Governing law and jurisdiction
These Terms are governed by Spanish law. Any dispute falls under the jurisdiction of the courts of Fuerteventura (Las Palmas), unless otherwise agreed in writing or where mandatory consumer-protection rules provide otherwise.
